Section 460
Clearing procedure

(1) A person who wishes to dispose of an immovable property in accordance with this paragraph, if the value of the property is mentioned in the document passed during the transfer of such property, and if such value is not mentioned, the amount of the prevailing market value should be deposited and filed with the office for passing such document. .
(2) If a complaint is received in accordance with sub-section (1), the office that passes the document shall send a date to the complainant to appear at such office within seven days, excluding the time limit of the ticket.
(3) If the person who has to clear the money within the time limit as per sub-section (2) is present and agrees to pay the money, the office issuing the document shall pay the amount deposited as per sub-section (1) and pay it to him.
(4) Even if the person who needs to be expunged within the period of subsection (2) is present and does not agree to be expunged, if it appears that expungement is necessary from the received complaint, the document passed and the office, the office that passed the document shall decide to expunge it and if it does not appear that it should be expunged, it shall decide not to expunge the complainant. Information according to the same should be given.
(5) If the person who needs to be cleared does not appear within the time limit as per sub-section (2), after the expiry of the deadline, if it is found that it is necessary to clear the complaint, the documents passed and the office, the office that passes the document decides to clear the property, and the person who receives the property is to be cleared. According to sub-section (1), a notice should be sent to the person who has to pay the deposit to come and collect the amount.
(6) If the person who has to clear the property is present within the period as per sub-section (2), but he disagrees with the market value of such property, the office of passing the document shall maintain the market value of such property and pay an amount equal to the market value to the person who gives the amount equal to the market value.
(7) Which of the maintained market value of the property to be liquidated in accordance with sub-section (6).If there is no agreement of the parties or if the person to be liquidated appears within the time limit and shows a reason why the liquidation should not be liquidated, and if it is found that the matter should be liquidated after understanding the evidence, the document passing office shall order the relevant court to proceed to liquidation within thirty-five days. It should be done according to the decision of the office.
(8) According to sub-section (4) when it is decided that the amount is not cleared and the amount is returned to the complainant, two and a half percent of the amount deposited as a bond as per sub-section (1) shall be deducted.
(9) If the person who makes the request for clean-up later does not want to pay for any reason or if he leaves the date, he shall be fined three percent of the bond amount, and the remaining amount shall be deducted from the bond amount and the remaining amount shall be returned to him.
